The reply from the head of the lifeguard program.

Several folks asked, so here's the response I got. Yeah, it was six weeks ago, but hey, I've been busy.

Solomon,

I have spoken to both lifeguards involved in this incident and explained to each one that we are lifesavers and not police. I believe the action taken by the first lifeguard (rude one) was because within two week on two separate occasions we have had two different people taking pictures of little kids and both were arrested. I believe the lifeguards are trying to make sure this doesn't happen again. However this is no excuse for the "beat it" attitude they showed you. It is a public beach where anyone can come down and take pictures of the waves or surfers. I believe this was a miscommunication.

As for the answers to your questions:

1) To my understanding Brevard County beaches are open to the public and taking pictures is perfectly fine. However when it comes to kids and women there is a fine line in what is appropriate. As for the ordinances/laws I'm not sure if there is any.

2) When it comes to our jurisdiction we have control of the swimming area (100 yards north and south of a tower), beach and boardwalks. However we have no legal right to force people off the beach with glass or dogs for example.

Police must be contacted to help the lifeguards.  As for the
park, if an emergency call occurs inside the park we will
respond to help, but police must be contacted if some issue that
arises.

3) Yes and no, again it is a fine line. We will contact police for their assistance. The police usually will back what we say needs to happen.

Again, I'm sorry for this incident, but understand the lifeguards are/will be watching out for the people that are taking improper pictures. Please do not let this stop your love for photography; I also enjoy taking pictures of surfing and animal life. If you have any other questions please feel free to call or email anytime.
