Yeah, I know the US government is run by a bunch of morons who don't know their country's history.. or have ever read the Constitution.
What is next? Will the courts now strip 'So help me God' from the pledge taken by new presidents? This is the worst kind of political correctness run amok."
That part of the oath isn't law. It was added by a Texan Judge during the rather hastily-arranged swearing-in of President Lyndon Johnson.
USC Article II, section 1: > Before [the President] enter on the Execution of his Office, he shall take the following Oath or Affirmation:--"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."
USC Ariticle VI: > The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.
If Congress feels this strongly about it, they can go ahead and amend the constitution. In the mean time, this will go to the Supreme Court, and it will be upheld unless the Constitution is changed.
